Terms of Service

The short version. Booking a party here is a simple deal. You pay half to hold your date and the rest at the start of your party, and your deposit stops being refundable 30 days out. You bring your own food. Adults watch their own kids, because our hosts run the party, they do not supervise children. No confetti. Everything below is the longer version of those rules, plus the legal terms that come with using this website.

1. Acceptance of Terms

By booking a party or using this website, you agree to these Terms of Service.

2. Service Description

Bouncing Fun Factory operates a private indoor birthday party venue at 211 Panther Way, Hewitt, Texas. When you book, you rent the whole facility for the duration of your party and no other party shares the space with you. This website exists to publish our packages and pricing and to take bookings. Using the website does not create any relationship beyond that, and no booking exists until a deposit has been paid and we have confirmed your date.

3. Eligibility

You must be 18 or older to book a party or enter into these terms. A parent or legal guardian must make the booking for any party held for a minor and is responsible for the booking and for the conduct of the guests attending.

4. Party Bookings and Payment

All bookings require a 50% non-refundable deposit to reserve your date and time. The remaining balance is due at the start of your party. Bookings are subject to availability.

Deposits are collected online through our booking page and processed by Stripe. Prices, package inclusions and the per-child fee for additional guests are the ones published on this website at the time you book. We do not run subscriptions or recurring billing of any kind.

5. Cancellation and Refund Policy

Deposits are non-refundable within 30 days of your party date. Credit card convenience fees are non-refundable. In the event of a cancellation, we will make reasonable efforts to help you rebook on an available date.

6. Venue Rules

No confetti, glitter, or confetti-filled items are permitted. Clients are responsible for any damage to the facility beyond normal use. Bouncing Fun Factory reserves the right to remove guests who are disruptive or unsafe.

7. Food and Beverage

Clients are responsible for all food, drinks, and cake brought into the facility. Bouncing Fun Factory is not responsible for food safety or allergies.

8. Supervision

Adult supervision of children is required at all times. Bouncing Fun Factory staff are present as party hosts, not as childcare providers.

9. Acceptable Use of This Website

You may use this website to learn about our packages and to book a party. You may not use it to attempt unauthorized access to our systems or accounts, to interfere with its operation, to scrape or copy it for a competing service, to submit false booking information, or for any unlawful purpose.

10. Intellectual Property

The Bouncing Fun Factory name, logo, photographs, page copy, and site design are owned by Bouncing Fun Factory and are protected by copyright and trademark law. You may share links to this site freely. You may not reproduce our photographs or copy for commercial use without written permission.

11. Third-Party Links and Services

This website links to and embeds services operated by other companies, including our booking and payment providers and our Google and Facebook business profiles. We do not control those services and we are not responsible for their content, availability, or data practices. Your use of them is governed by their own terms.

12. Disclaimers

This website and its content are provided as-is. We work to keep pricing, availability, and package details accurate, but we do not warrant that every detail on the site is error-free or current at all times, and an obvious error in published pricing does not oblige us to honor it. Nothing in this section limits any warranty that cannot be disclaimed under Texas law.

13. Assumption of Risk and Limitation of Liability

Bouncing Fun Factory is not liable for injuries resulting from failure to follow posted safety rules. Participation in inflatable and physical activities is at the participant's own risk.

To the fullest extent permitted by law, our total liability arising out of a booking or your use of this website is limited to the amount you actually paid us for that booking, and we are not liable for indirect or consequential losses such as lost time, travel costs, or the cost of arranging an alternative party. Nothing in these terms limits liability that cannot be limited under Texas law, including liability for personal injury caused by our own negligence, for gross negligence, or for willful misconduct.

14. Indemnification

You agree to indemnify Bouncing Fun Factory against claims, damages, and reasonable costs arising from your misuse of this website, your breach of these terms, damage to the facility caused by your guests, or the conduct of guests attending your party.

15. Termination and Refusal of Service

We may refuse or cancel a booking, or remove guests from the facility, where these terms or the posted safety rules are broken, where staff or other guests are put at risk, or where a booking was made with false information. Where we cancel a booking for a reason that is not your fault, we will refund what you have paid for it.

16. Governing Law and Venue

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute that reaches a court will be brought in the state or federal courts located in Texas, and both sides consent to those courts hearing it.

17. Dispute Resolution

If something goes wrong, contact us first at (254) 709-0036 or bouncingfunfactory@hotmail.com and give us a fair chance to put it right. Most problems are solved in one phone call. If we cannot resolve it informally within 30 days, either side may take the matter to the courts identified in section 16, including small claims court where the claim qualifies.

18. Changes to Terms

We reserve the right to update these terms at any time. Continued use of this website or booking services constitutes acceptance of updated terms.
